These Terms & Conditions ("Terms") govern your access to and use of the services provided by Murcia Production Service ("we", "us", or "our"), a production support company based in Murcia, Spain. By engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

Services Overview

We provide audiovisual production support in Murcia, Spain, including but not limited to: location scouting, crew assembly, logistics coordination, set design, equipment rentals, and tax incentives consulting.

Services are customised per project and described in individual agreements or statements of work. These Terms apply to all engagements unless superseded by a signed contract.

Eligibility & Accounts

You must be at least 18 years of age, or have the consent of a legal guardian, to engage our services.

When creating an account or submitting a project inquiry, you agree to provide accurate, current, and complete information. We reserve the right to suspend or terminate access for any violations of these Terms.

Prohibited conduct includes: illegal use of our services, unsolicited communications (spam), and infringement of third-party intellectual property rights.

Fees & Payment

All quotes are non-binding until a formal contract is signed by both parties.

Payment schedule: 50% upfront upon contract signing; the remaining balance is due upon agreed milestones or final delivery.

Late fees: Overdue payments are subject to a late fee of 1.5% per month on the outstanding balance.

Refunds: Payments are non-refundable once services have commenced, except in cases of force majeure as outlined in Section 8.

Taxes: You are responsible for your applicable VAT obligations. We are pleased to assist in maximising Spanish production tax incentives, which may provide rebates of up to 30% on qualifying expenditure.

Intellectual Property

Your Content: You retain full ownership of any content, scripts, or creative materials you provide. By sharing them with us, you grant Murcia Production Service a non-exclusive, royalty-free licence solely for the purpose of delivering the agreed services.

Our Deliverables: All deliverables produced under a project (including location reports, designs, and production assets) are licensed to you upon full payment. Resale or sub-licensing without our written consent is prohibited.

Infringement Claims: If you believe your intellectual property rights have been violated, please notify us promptly at info@murciaproductionservice.com . We comply with applicable copyright law including DMCA procedures.

Conduct & Liability

You agree to comply with all applicable local, national, and international laws. Harassment, discrimination, or abusive conduct directed at our team or partners is grounds for immediate termination.

Disclaimer: Services are provided "as-is". We make no warranties, express or implied, regarding fitness for a particular purpose.

Limitation of Liability: Our total liability to you shall not exceed the total fees paid by you in the three months preceding the claim.

Indemnification: You agree to hold Murcia Production Service harmless from any claims, losses, or damages arising from your content or actions.

Termination

Either party may terminate the engagement for material breach with 30 days' written notice, unless the breach is remedied within that period.

Upon termination, each party shall return or delete the other's confidential data, and any outstanding payments become immediately due.

Governing Law & Disputes

These Terms are governed by the laws of Spain. Jurisdiction lies with the Courts of Murcia.

All disputes shall first be submitted to mandatory mediation. If unresolved within 60 days, they shall be referred to binding arbitration under the rules of the Spanish Arbitration Club (Club Español del Arbitraje).

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Miscellaneous

Force Majeure: Neither party is liable for failure to perform obligations caused by circumstances beyond reasonable control, including but not limited to extreme weather, strikes, government actions, or natural disasters.

Amendments: We may update these Terms at any time. Continued use of our services after notification constitutes acceptance of the revised Terms.

Entire Agreement: These Terms, together with any signed contract or statement of work, constitute the entire agreement between the parties.
